My wife’s former employer told her that they will mail out her W2 in February. Is this legal? What should we do? ?

They went out of business a month ago. She was laid off a few months ago.

Edit: the business didn’t close, just the location

    The law states that W2s should be mailed by Feb 1. In practice, there's not much you can do if they're a little late. Just wait for it. 

    Her last paystub should have basically the same info on it if you want to look at that.

    No it is not legal under normal circumstances employers are legally required to mail your W2 by the end of January.

    But keep in mind there may be some exceptions being allowed due to the pandemic.
