Does netflix have the right to film a remake of the Nickelodeon show?

They would need whats called a release and/or "License to Use"  aka LTU signed from the Nickelodeon show your speaking of to use the name, image, or likeness of the show. Any show on national television on a big network will require that and all industry people know this. So, that LTU was already handled before filming would even start, otherwise, the lawsuit would have production shut down before they even got started good.

The owners of the show can remake it or sell the rights to someone else to do it.

They do if they bought the rights although I can't think of anything that they would want to remake besides Phineas and Ferb.
