How long would it take to stack the court if Biden was elected with a House and Senate, and stretch the number to 13?

    Theoretically, Biden could do this in the first year of his presidency. Congress would have to pass a bill changing the number of SCOTUS justices from 9 to 13. That would take 3 months.


    Biden could then nominate 4 additional SCOTUS justices. Assuming the confirmation process took 2 months for each judge we'd be at 11 months before they were seated.


    Of course, Democrats would have to take one final step. If it appears they were going to lose their Senate majority, they'd have to pass a law so that adding or subtracting additional justices required a supermajority vote rather than just a simple majority. That way Republicans could never come back and do the same thing.
