Cops stop a vehicle for speeding and smells weed and tells the 3 ppl to get out to search the car.?

He searches the car and finds a gun in the trunk and asks who's gun is this without revealing the item. The black guy who is the driver states that the gun isnt his , the white guy who is in passenger side state that the gun isnt his either.  The Asian guy who is in the back seat claims that the 9 millimeter is not his and states that it belongs to the driver. Keep in mind that noone in the car holds a gun license. Who does the cop arrest ?

    Well, Steven CAPS is an idiot, so you can ignore his answer.

    The laws vary by jurisdiction, and you didn't say where this is supposedly happening.  Where I live, all three would be arrested for unlawful carrying of a firearm, though only one would be formally charged once the cops figured out whose gun it really is.  Or they could charge all three.  That's because owning a handgun is perfectly legal where I live, but carrying one in a vehicle (even unloaded) is perfectly not.

    In most US states where carrying a gun in a vehicle is allowed, it's still against the law for the owner to deny that it's their gun.  Even the most gun-happy US states have laws about lying about whose gun it is.

    Based on your scenario they MAY all be arrested.

    Obviously the Asian guy was aware the gun was there as he knew the caliber ... the driver is responsible for it since it was in his vehicle 

    The question is what state are they in ... some states do require a gun license and so it would t matter if there was no licensed occupants

    In your scenario, the officer is reprimanded for accessing the trunk without a warrant and anything found in the trunk is inadmissible in court. In any case, the gun in the trunk is legal.

    In my State all 3 are held for questioning.  No one is arrested until AFTER the questioning.  Locked in the trunk?  The vehicle owner is the most likely to be arrested if no one else comes forward.

    In reality probably all three in the hopes that by threatening them all with charges they can get two to coalesce in their stories against the other.

    Since it's pretty well B.S. because you did not describe the state where this happened. In Arizona, a firearm in the trunk is locked away and it doesn't matter, plus you don't a license to possess the weapon. Since the cop did not find any weed, no law appears to be broken, even though the Asian kid must be the owner because he describes it more detail than the others. The cops don't arrest anyone because they are all 21 yrs old or older.

    Probably all three.   Whether anyone is charged or not depends on the result of the investigation.
