If my neighbor has a Wooden stake hanging 1 foot into my yard and my son who is a visitor hit himself with that wooden stake can I sue?

    Sue who? The neighbor? When your son was clearly the negligent party? Tell your son to wise up and look where he is going.

    If he contracts a flesh-eating bacteria and loses a limb you'd have real damages. Minus something that severe your only damages are the cost of a Band-Aid. But you can contact your city's Building & Safety Dept. to do an inspection and issue him a citation to change the situation.
